Tetra Tech provides an overview of the UK’s REACH program and its potential impact on regulations pertaining to chemical

在本文中, 将马丁, a Tetra Tech partner with expertise in UK product compliance requirements, 提供了英国注册的概述, 评价, and Authorization of Chemicals (REACH) program and its potential impact on chemicals regulations.

在许多分歧之后, 英国于1月31日脱离欧盟, 2020, 现在进入过渡期,有效期至2020年底, at which point the future trade relationship with the EU will be negotiated.

2019年1月,特蕾莎·梅政府通过了一项法案 英国法定文书 to provide a chemicals regulatory framework in the UK in the event of a no-deal exit. 以下内容由欧盟REACH提供, 其中欧盟实体被英国实体所取代;

  • The European Chemicals Agency (ECHA) regulatory authority is replaced by the UK 健康 and 安全 Executive (HSE)
  • The 欧盟达成-IT database is replaced by Comply with UK REACH, a new UK system

Chemical manufacturers (or only representatives acting on their behalf) and importers must register substances in order to identify any hazardous properties of those substances. 识别危险的地方, they must check that all supported uses of that substance in the supply chain are safe through the development and communication of appropriate risk management measures and operational conditions. Without a registration in place, substances cannot legally be placed on the market.

To avoid supply disruption when UK REACH comes into effect at the end of the transition period,

  • UK companies that transferred 欧盟达成 registrations to EU-based entities in order to retain access to EU markets in the event of a no-deal Brexit will also transfer into UK REACH
  • 对于上述两种情况, registrants will be required to submit basic data about the substance as a notification in the REACH-IT system within 120 days of the end of the transition period. Full information appropriate to the registrant’s tonnage band will then need to be submitted within two years. No new fees will be payable for 欧盟达成 registrations that are re-registered under UK REACH.
  • UK-based companies purchasing substances or preparations from EU-27 countries are currently downstream users under 欧盟达成. 根据英国REACH法规, they will become importers, meaning they will need to register substances. It is expected this information will be available from safety data sheets generated by 欧盟达成 registrants. This interim notification will then need to be replaced with a full UK REACH registration after two years. EU-27 countries will be able to establish only representatives in the UK in order to benefit from this transitional arrangement and take on the registration obligation on behalf of their UK-based customers.
UK-based holders of an 欧盟达成 authorization can continue to apply that authorization in the UK under UK REACH. 这些公司有60天的时间(截至3月1日), 2021) to provide the UK HSE with technical information relating to the authorization.

根据北爱尔兰议定书的条款, negotiated as part of Boris Johnson’s withdrawal agreement with the EU, Northern Ireland will continue to follow EU rules on agricultural and manufactured goods and will continue to follow 欧盟达成.

It should be stressed that as of the date of this article, UK REACH is still in development.

在特蕾莎·梅政府领导下, there was a commitment to seek continued membership in ECHA and to continue operating under 欧盟达成 through some form of associate membership. With the advent of the Boris Johnson government and its chosen path of a hard Brexit, 约翰逊还重申,如果没有达成贸易协议, the UK would revert to World Trade Organization rules at the end of the transition period.

2020, with the announcement that the UK would be leaving the European Aviation 安全 Agency (EASA) at the end of the transition period. The trade body, ADS, has estimated it will take up to 10 years and cost up to £40 million (about $51.5 million) annually to create a UK safety authority with all the expertise of EASA. It would also increase the regulatory burden and cost for UK-based aerospace manufacturers. 英国政府表示,这些费用是必要的,因为, “being a member of the [EASA] is not compatible with the UK having genuine economic and political independence.”

当然, it is too soon to know precisely what will happen in the trade negotiations, 或者外部因素, 比如冠状病毒大流行, 是否会对会谈的进展产生影响. 鉴于政府对未来与欧盟关系的愿景, it seems unlikely that the UK will be operating within the framework of 欧盟达成 following the end of the transition period. It also is unlikely that the UK will seek to extend the transition period given that one of the Johnson government’s first acts was to pass an amendment to the Withdrawal Agreement Bill, On that basis, the industry is preparing for UK REACH to be in force on January 1, 2021.
